The House of Delegates yesterday approved the measure restricting the Governor’s power to appoint an Interim US Senator.

Under House Bill 1696, the Governor would immediately issue a writ to call for a special election once there is a vacancy. The seat would remain vacant until the special election is held. Right now, the Governor can appoint a replacement who would hold the seat until the next regularly-scheduled election.

Last fall, Virginia Senator Tim Kaine was the Democrat’s Vice-Presidential nominee. Had the Democratic ticket won the election, Governor Terry McAuliffe would have made a temporary appointment to fill Kaine’s seat until the next previously-scheduled election.

The bill cleared the House on a 64-34 vote. It now goes to the State Senate.
